Terms of Service

1. Acceptance of Terms

By accessing or using Immigie ("the Platform"), operated at immigie.com and via our mobile applications, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of Immigie after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.

2. Eligibility

You must be at least 18 years of age to create an account and use Immigie. By creating an account, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from using the Platform under any applicable law.

If we discover or have reason to believe that a user is under 18, we will immediately terminate that account and delete all associated data.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for safeguarding your password and for all activity that occurs under your account, whether or not authorised by you.

Each person may maintain only one account. Accounts are non-transferable. We reserve the right to suspend or terminate accounts that contain inaccurate, misleading, or fraudulent information, or that violate these Terms, without prior notice and without liability to you.

4. Location Data & Community Matching

Immigie uses your location data to connect you with nearby community members of the same nationality and country. By enabling location services, you consent to the collection and processing of your geolocation data as described in our Privacy Policy.

  • Your approximate location is used to match you with nearby users and display relevant community content, events, and businesses.
  • You may revoke location permissions at any time through your device settings, which may limit certain features.
  • We do not share your precise GPS coordinates with other users. Only your city and country are displayed on your profile.

5. User Content & Community Guidelines

You retain ownership of content you post on Immigie. By posting content, you grant Immigie a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, display, reproduce, modify, distribute, and create derivative works of your content in connection with operating, promoting, and improving the Platform. This licence survives termination of your account for content that has been shared with other users or incorporated into the Platform. You may delete your content at any time, which will terminate this licence for future use, but copies that have already been distributed or cached may persist.

You represent and warrant that you have all rights necessary to grant this licence, and that your content does not infringe, misappropriate, or violate any third party's rights.

Immigie is a cultural community platform. To maintain a safe and welcoming environment, you agree not to:

  • Post content that is hateful, discriminatory, threatening, harassing, defamatory, obscene, or sexually explicit
  • Impersonate another person, entity, or misrepresent your nationality, identity, or affiliation
  • Share spam, misleading content, scams, pyramid schemes, or malicious links
  • Use the Platform for any illegal activity, including fraud, money laundering, or trafficking
  • Scrape, harvest, or collect user data without authorisation, or use bots, crawlers, or automated tools
  • Interfere with or disrupt the Platform's integrity, security, or performance
  • Upload content that infringes on the intellectual property rights of others
  • Attempt to gain unauthorised access to any part of the Platform, other user accounts, or our systems
  • Use the Platform to stalk, harass, bully, or intimidate other users

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice and without liability. Immigie is not obligated to monitor all user content but reserves the right to do so.

6. Connections & Messaging

Immigie facilitates connections between diaspora community members. By using the connection and messaging features, you agree to:

  • Communicate respectfully with other members
  • Not use messaging for solicitation, harassment, or unsolicited commercial messages
  • Report any abusive or inappropriate behaviour using the in-app reporting tools

Immigie is not responsible for the conduct of any user, whether online or offline. All interactions with other members, including in-person meetings, are entirely at your own risk. You acknowledge that Immigie does not conduct background checks, verify identities beyond basic profile information, or screen users. You agree to take reasonable precautions when communicating with or meeting other users.

7. Events & Ticketing

Immigie allows users to create, promote, and attend community events. The following terms apply:

7.1 Event Organisers

  • All events are subject to review and approval before publication. Immigie reserves the right to reject events that violate our guidelines.
  • Organisers are solely responsible for the accuracy of event details, the delivery of the event as described, and compliance with all applicable local laws, regulations, permits, and insurance requirements.
  • Organisers must not create fraudulent, misleading, or deceptive events.
  • Organisers agree to indemnify Immigie against any claims, damages, or losses arising from their events.

7.2 Ticket Sales & Fees

  • For paid events, Immigie acts as the payment facilitator, not the event organiser. A 20% platform fee is deducted from all ticket sales. The remaining 80% is remitted to the event organiser.
  • Ticket prices are set by the organiser and displayed in the organiser's selected currency.
  • Payments are processed securely via Stripe. Immigie does not store your full payment card details.
  • Payouts to organisers are processed after the event has taken place, subject to our payout schedule and fraud review.

7.3 Ticket Purchasers

  • By purchasing a ticket, you enter into a transaction with the event organiser, not Immigie. Immigie is not the organiser and bears no responsibility for the event itself, including cancellations, changes, or quality.
  • Refund policies are set by individual event organisers. Contact the organiser directly for refund requests. Immigie is not obligated to issue refunds on behalf of organisers.
  • Each ticket includes a unique ticket code for event check-in. Do not share your ticket code with others.

7.4 Assumption of Risk

By attending any event listed on Immigie, you assume all risks associated with attendance, including but not limited to personal injury, property damage, illness, or any other harm. Immigie is a listing platform only and is not responsible for the safety, legality, or conduct of any event or its attendees.

8. Business Listings

Immigie provides a business directory for community-owned businesses. By listing a business, you represent that:

  • You are the owner or an authorised representative of the business
  • All information provided is accurate and not misleading
  • The business complies with all applicable laws and regulations in its operating jurisdiction

Business listings are subject to verification before publication. Immigie reserves the right to remove or reject listings that are fraudulent, misleading, or violate these Terms. Immigie does not endorse, verify, or guarantee the quality, safety, legality, or accuracy of any business listed on the Platform. Any transactions or interactions with listed businesses are solely between you and the business owner.

9. Subscription Plans & Payments

Immigie offers subscription plans (Basic, Premium) with additional features. By subscribing, you agree to the following:

  • Subscription fees are billed in advance on a recurring basis (monthly or annually) at the rate displayed at the time of purchase.
  • Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
  • We reserve the right to modify pricing with at least 30 days' advance notice. If you do not agree to the new pricing, you must cancel before the next billing cycle.
  • Refunds are handled in accordance with applicable law and Stripe's refund policies. Chargebacks filed without first contacting Immigie support may result in account suspension.

9.1 Free Trials via Invite Programme

Users may earn free trial periods by inviting friends to join Immigie. Trial periods are one-time rewards, non-transferable, and subject to the invite programme rules. Trials automatically expire and revert the account to the free tier unless the user subscribes to a paid plan. Immigie reserves the right to modify or discontinue trial offers at any time.

10. Invite & Referral Programme

Immigie's invite programme allows users to earn rewards by referring new members. By participating:

  • You agree not to spam, harass, or use deceptive practices to acquire referrals
  • Invitees must be real individuals who genuinely create and use an account
  • Fake, duplicate, or fraudulent referrals will not count and may result in account suspension
  • Immigie reserves the right to modify, suspend, or discontinue the referral programme at any time without prior notice
  • Rewards have no cash value and are non-transferable

11. Intellectual Property

The Immigie name, logo, design, and all associated trademarks, service marks, and proprietary content are owned by Immigie. You may not use, copy, modify, or distribute our intellectual property without prior written consent. The Platform and its original content (excluding user-generated content) are protected by copyright, trademark, and other applicable intellectual property laws worldwide.

Any feedback, suggestions, or ideas you submit to Immigie become our property and may be used without obligation to you.

12. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. By using Immigie, you consent to the data practices described therein.

You may request deletion of your personal data at any time through the account settings or by contacting us at privacy@immigie.com.

13. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Immigie does not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components. Immigie does not guarantee the accuracy, completeness, or reliability of any content, profiles, business listings, or event information on the Platform.

Immigie is a platform that connects users. Immigie does not conduct criminal background checks, identity verification beyond basic profile review, or screening of any user. You are solely responsible for your interactions with other users and any consequences thereof.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMMIGIE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF IMMIGIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL IMMIGIE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO IMMIGIE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

This limitation applies to all claims, including without limitation claims arising from:

  • Interactions with other users, whether online or in person
  • Events attended or tickets purchased through the Platform
  • Business listing inaccuracies or misrepresentations by third parties
  • Unauthorised access to or alteration of your data
  • Any conduct or content of any third party on the Platform

15. Indemnification

You agree to indemnify, defend, and hold harmless Immigie and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Platform or violation of these Terms
  • Your content or any activity under your account
  • Your violation of any applicable law, regulation, or third-party rights
  • Any event you organise through the Platform
  • Any business you list through the Platform
  • Any dispute between you and another user

16. Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal proceeding, you agree to first contact us at legal@immigie.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorised access. The arbitration shall be conducted in accordance with the rules of the London Court of International Arbitration (LCIA).

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Immigie.

For users in the European Union: Nothing in this section restricts your rights under mandatory consumer protection laws of your country of residence, including your right to bring claims in the courts of your country of residence.

For users in the United States: You agree that any arbitration shall take place in the State of Delaware, and the Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.

17. Termination

You may terminate your account at any time using the account deletion feature in your settings or by contacting us. We may suspend or terminate your access at any time, without prior notice or liability, for any reason, including violations of these Terms. Upon termination:

  • Your right to use the Platform ceases immediately
  • Active subscriptions will not be refunded for the current billing period
  • Pending event ticket payouts may be held for up to 90 days for fraud review
  • Your data will be handled in accordance with our Privacy Policy and data deletion procedures
  • Sections 5 (content licence), 13-16 (disclaimers, liability, indemnification, dispute resolution), and 20 (general provisions) shall survive termination

18. Force Majeure

Immigie shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, cyberattacks, or third-party service outages.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

For users in the European Union: You retain any mandatory consumer protection rights afforded to you under the laws of your country of residence. Nothing in these Terms affects your rights as a consumer under EU Regulation 2019/1150 or other applicable EU consumer protection legislation.

For users in the United States: To the extent that federal law does not preempt, these Terms shall be governed by the laws of the State of Delaware without regard to its conflict of law provisions.

20. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Immigie regarding the Platform and supersede all prior agreements, understandings, and representations.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Waiver: The failure of Immigie to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Immigie.

Assignment: You may not assign or transfer these Terms or any rights hereunder without Immigie's prior written consent. Immigie may assign these Terms without restriction.

No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
